Punjab National Bank Amends Officers' Service Regulations, Revising Pay Scales, Allowances, and Leave Policies

The Punjab National Bank (Human Resources Development Division) issued a Notification on March 27, 2020, introducing the Punjab National Bank (Officers') Service (Amendment) Regulations, 2020. These regulations, published in the Gazette of India, Part III—Section 4, were enacted in exercise of powers conferred by section 19, read with sub-section (2) of section 12 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970. The amendments, made by the Bank's Board of Directors after consultation with the Reserve Bank of India and with the previous sanction of the Central Government, largely came into force retrospectively from November 1, 2012, with specific provisions effective from later dates such as May 1, 2015, May 25, 2015, and June 1, 2015. The primary reason for the enactment, as detailed in the Explanatory Memorandum, was to update and revise various service conditions for the bank's officers.
The amendments introduced significant changes across several aspects of officers' service. A key modification was the expanded definition of "family" to include wholly dependent physically and mentally challenged brothers or sisters, widowed daughters, dependent divorced or separated daughters, and sisters (unmarried, divorced, abandoned, separated, or widowed). For married female officers, the definition now includes natural parents or parents-in-law, but not both, with a "wholly dependent" income threshold set at Rs. 10,000 per month. The regulations also revised the pay scales for all grades, from Junior Management to Top Executive, with retrospective effect from November 1, 2012, and introduced a new Scale VIII for the Chief General Manager post. Alongside revised pay scales, a Special Allowance was introduced, payable as a percentage of Basic Pay plus Dearness Allowance, though it would not be reckoned for superannuation benefits. Increments and stagnation increments were also updated, providing for further increments for officers reaching the maximum of their respective scales. Professional Qualification Pay (PQP) for those with JAIIB/CAIIB qualifications and Fixed Personal Pay (FPP) were also revised. The categorisation of posts was updated to reflect the new grade structure, including the Chief General Manager in Top Executive Grade Scale-VIII. Dearness Allowance (DA) calculations were revised, linking them to the All India Average Working Class Consumer Price Index, with "pay" for DA purposes now including basic pay, stagnation increments, and special allowance. Provisions related to residential accommodation and House Rent Allowance (HRA) were updated, specifying recovery rates for bank accommodation and revised HRA rates based on the place of work. City Compensatory Allowance (CCA) and Special Areas Allowances for various geographical regions across India were also revised. New allowances were introduced, such as a Mid-Academic Year Transfer Allowance from June 1, 2015, for officers with children studying, and revisions were made to Deputation Allowance and Split Duty Allowance. Medical expenses reimbursement limits were increased, and a Medical Insurance facility for officers and their families was introduced. Leave policies saw substantial changes, including an increased Privilege Leave accumulation limit to 270 days, with encashment restricted to 240 days. A new Special Sick Leave of up to 30 days was introduced for kidney or organ donation. Maternity leave provisions were clarified, and new leave types were introduced: adoption leave for childless female officers (up to six months for legally adopting a child below one year, also applicable to biological mothers in surrogacy cases) and paternity leave for male officers (15 days for up to two surviving children). The regulations also clarified the lapse and encashment of privilege leave upon resignation, retirement, death, or compulsory retirement. Travel entitlements for officers on duty, including class of travel by air or train, and Halting Allowance rates, were updated, as were provisions for hotel expense reimbursement and lump sum amounts for transfer expenses. Leave Travel Concession (LTC) rules were also modified, offering options for travel to domicile or any place in India and provisions for encashment.
The legislative intent behind these amendments was to update and rationalize the service conditions, compensation structure, and welfare benefits for officers of the Punjab National Bank. The earlier legal position was governed by the Punjab National Bank (Officers') Service Regulations, 1979, which these amendments sought to modify. The revisions addressed statutory gaps and aimed to align the benefits with contemporary standards and employee needs. The retrospective application of many provisions, particularly those related to pay and allowances, was explicitly stated to be beneficial in nature. The legislation provided: “The retrospective effect given in these regulations relate to the pay and other allowances and benefits to the officers of the Punjab National Bank and are essentially beneficial legislation. Hence, giving retrospective effect to the said provisions of these regulations will not adversely affect the interest of any person as a result of such retrospective application.” This approach ensures that officers receive updated benefits for past periods. The amendments introduce new rights, such as expanded family definitions for dependency benefits and new leave categories like adoption leave and paternity leave, reflecting evolving social norms and employee welfare considerations. The detailed revisions to allowances, such as Dearness Allowance, House Rent Allowance, and Special Area Allowances, aim to provide a comprehensive and fair compensation framework. Enforcement mechanisms are inherent in the regulations themselves, with specific effective dates for each provision, ensuring clarity on when the new rules apply.
