Punjab National Bank Amends Regulations for Officer Employees' Post-Retirement Private Sector Employment

The Punjab National Bank Officer Employees' (Acceptance of Jobs in Private Sector Concerns After Retirement) Amendment Regulations, 2020, were issued as a notification by the Punjab National Bank on March 27, 2020. These regulations were enacted by the Board of Directors of the Punjab National Bank, exercising powers conferred by section 19, read with sub-section (2) of section 12 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970. This action followed consultation with the Reserve Bank of India and received the prior sanction of the Central Government. The primary purpose of this instrument was to further amend the existing Punjab National Bank Officer Employees' (Acceptance of Jobs in Private Sector Concerns After Retirement) Regulations, 2000, which govern the conditions under which retired officer employees of the bank may accept employment in private sector concerns. The amendments introduced key changes, including the substitution of sub-regulation (6) of regulation 4, which now mandates that every order passed by the Bank under these regulations shall be communicated to the person concerned. Furthermore, a new regulation 5 was inserted, which explicitly defines the "Competent Authority" responsible for granting or refusing permission for such post-retirement employment. These regulations came into force with effect from the date of their publication in the Official Gazette, which was March 27, 2020.
The legislative intent behind these amendments was to streamline and formalize the process for Punjab National Bank officer employees seeking to accept jobs in private sector concerns after their retirement. The earlier legal position, established by the principal regulations published in 2000 and last amended in 2015, outlined the general framework for such permissions. However, the present amendment addresses potential statutory gaps by clearly delineating the specific authorities responsible for making these decisions based on the officer's grade. This structured approach aims to enhance transparency and efficiency in the approval process. The legislation provided: “5. Competent Authority.- The Competent Authority for granting or refusing permission for acceptance or taking up any employment in private concern after retirement, by an officer employee under regulation 4, shall be as given in the table below:-” This new regulation then specifies a tiered system, assigning the authority to General Manager or Chief General Manager-HR for Junior Management Grade Scale-I, Middle Management Grade Scale-II and III, and Senior Management Grade Scale-IV officers. For Senior Management Grade Scale-V and Top Executive Grade Scale-VI officers, the Executive Director heading HR is designated as the Competent Authority. The highest-ranking officers, those in Top Executive Grade Scale-VII and Top Executive Grade Scale-VIII, require permission from the Managing Director and Chief Executive Officer. These amendments introduce a clear enforcement mechanism by assigning specific roles and responsibilities within the bank's hierarchy for managing post-retirement employment requests, thereby ensuring that decisions are made by appropriate levels of management and communicated effectively to the concerned individuals.
