Punjab National Bank Updates Disciplinary and Appeal Regulations for Officer Employees

The Punjab National Bank Officer Employees' (Discipline & Appeal) Regulations, 1977, which govern the conduct and disciplinary proceedings for its officer employees, have been updated with changes as on March 31, 2017. These regulations, originally brought into force on January 1, 1977, establish a comprehensive framework for addressing misconduct and imposing penalties within the bank's officer cadre. The instrument, a set of regulations, delineates the types of penalties, the authorities competent to institute disciplinary proceedings, and the detailed procedures for imposing both minor and major penalties. It applies to all officer employees of the bank, encompassing those holding supervisory, administrative, or managerial posts, as well as those temporarily deputed to other organizations. However, it explicitly excludes the Chairman, Managing Director, Whole-time Directors, casual employees, award staff, and officers on contract. The regulations define various key terms such as "Act" (referring to the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970), "Appellate Authority," "Disciplinary Authority," and "Reviewing Authority," specifying their roles within the disciplinary process.

The regulations also specify actions that do not constitute a penalty, such as withholding increments for failing departmental tests or reversion from an officiating higher post due to unsuitability. A detailed procedure is laid down for imposing major penalties, requiring a formal inquiry with definite charges, a statement of allegations, and opportunities for the officer employee to present a defense. The legislation provided: “The following are the penalties which may be imposed on an officer employee, for acts of misconduct or for any other good and sufficient reasons : Minor Penalties: (a) Censure (b) Withholding of increment of pay with or without cumulative effect; (c) Withholding of promotion; (d) Recovery from pay or such other amount as may be due to him of the whole or part of any pecuniary loss caused to the bank by negligence or breach of orders. (e) Reduction to a lower stage in the time scale of pay for a period not exceeding 3 years, without cumulative effect and not adversely affecting the Officer's pension. Major penalties: (f) Save as provided for in (e) above reduction to a lower stage in the time scale of pay for a specified period, with further directions as to whether or not the officer will earn increments of pay during the period of such reduction and whether on the expiry of such period the reduction will or will not have the effect of postponing the future increments of his pay; (g) Reduction to a lower grade or post; (h) Compulsory retirement; (i) Removal from service which shall not be a disqualification for future employment; (j) Dismissal which shall ordinarily be a disqualification for future employment.”

The Appellate Authority is empowered to confirm, enhance, reduce, or set aside penalties, with provisions for further inquiry if an enhanced major penalty is contemplated. The Reviewing Authority can re-examine final orders within six months if new material evidence emerges. The regulations also mandate consultation with the Central Vigilance Commission for disciplinary cases involving a vigilance angle, underscoring the commitment to integrity and oversight. The "Repeal & Saving" clause ensures a smooth transition from previous rules, deeming actions taken under repealed provisions as valid under the new regulations and preserving accrued rights of appeal.
