Sikkim Amends Labour Rules to Refine Worker Count Thresholds

The Government of Sikkim, through its Department of Labour, issued a significant notification on October 22, 2024, bringing into effect the Sikkim Labour (Regulation of Employment and Conditions of Service) Amendment Rules, 2024. This legislative instrument, published in the Sikkim Government Gazette Extraordinary on October 29, 2024, was enacted in exercise of the powers conferred by section 35 of the Sikkim Labour (Regulation of Employment and Conditions of Service) Act, 2021. The primary objective of these new rules is to amend specific provisions within the existing Sikkim Labour (Regulation of Employment and Conditions of Service) Rules, 2021, thereby clarifying the applicability of certain labour regulations based on the number of workers employed in an establishment. The Amendment Rules extend to the entire state of Sikkim and came into force immediately upon their publication in the Official Gazette.

The key changes introduced by the 2024 Amendment Rules focus on Rule 25 of the principal Rules. Under sub-rule (1) of Rule 25, the previous entry "Upto 100 workers" has been substituted. The legislation provided: “…for the existing entry " Upto 100 workers ", the following entry shall be substituted, namely; - " 10 to 100 workers "”. This modification means that the provisions of sub-rule (1) now specifically apply to establishments employing between 10 and 100 workers, rather than broadly to all establishments with up to 100 workers, which would have included those with fewer than 10 employees. Furthermore, sub-rule (4) in clause (a) of Rule 25 also saw a similar refinement. The earlier entry "Number of workers not exceeding 20," was replaced with "Number of workers exceeds 09 but does not exceed 20." This clarifies the scope of this particular clause, ensuring its application to establishments with 10 to 20 workers, while explicitly excluding those with nine or fewer employees. These amendments directly impact the scope of compliance for various establishments across Sikkim, particularly small and medium-sized enterprises (SMEs), by setting precise numerical thresholds for the application of certain labour conditions and employment regulations.

The legislative intent behind these amendments appears to be a refinement of the statutory framework governing labour and employment conditions in Sikkim. The earlier legal position, which used phrases like "Upto 100 workers" or "not exceeding 20," might have led to ambiguity regarding the inclusion or exclusion of very small establishments (e.g., those with 1 to 9 workers). By introducing explicit lower bounds such as "10 to 100 workers" and "exceeds 09 but does not exceed 20," the State Government has addressed these potential statutory gaps and issues. This move aims to ensure that the regulatory burden and specific compliance requirements are appropriately tailored to the size and capacity of different establishments. The amendments do not introduce entirely new rights or obligations but rather clarify the existing ones by precisely defining the categories of employers to whom certain provisions of the Sikkim Labour (Regulation of Employment and Conditions of Service) Rules, 2021, apply. This precision in defining worker thresholds is a common practice in labour legislation to differentiate between micro, small, and medium enterprises for regulatory purposes.
