Sikkim Enacts Legislation for Establishment of Orchid University to Advance Skill-Oriented Higher Education

The Sikkim Legislative Assembly has passed the Orchid University Act, 2024 (Act No. 06 of 2024), which received the assent of the Governor on July 11, 2025, and was subsequently published in the Official Gazette on August 7, 2025. This Act provides for the establishment and incorporation of Orchid University as a self-financed private university in the State of Sikkim, specifically located in Mangan District. The legislation was enacted with the aim of promoting high-quality, comprehensive educational, research, and training opportunities to address the challenges of rapidly evolving technology and globalization. It seeks to impart knowledge and skills, positioning the university as a Centre of Excellence in fields such as Technology, Management, and Skill Development. The university is planned as a multi-domain higher education institution, offering various levels of degrees and diplomas, from certificates to PhDs, across diverse disciplines including Vocational Education, Arts, Commerce, Management, Library Science, Computer Science and Application, Yoga, and Journalism and Mass Communication. The Peace of Dream Foundation, a non-profit organization, sponsors the initiative. The Act stipulates that the university shall come into force on a date appointed by the State Government through a notification in the Official Gazette.

The legislation provided: “AN ACT to provide for the establishment and incorporation of ORCHID UNIVERSITY in the State of Sikkim and matters connected therewith and incidental thereto.”

The primary objective of the Orchid University Act, 2024, is to foster the creation of a new educational paradigm in Sikkim that is responsive to contemporary global demands. The legislative intent is to produce well-educated, socially and environmentally aware, and responsible citizens, equipped to contribute to the nation's progress. A core policy rationale is to establish a leading institution for quality skill education, recognized both nationally and internationally, thereby developing a highly skilled and entrepreneurial workforce. The Act addresses the need for technologically competent youth and aims to promote the "Make in India" concept through entrepreneurship and skill development in manufacturing industries. It seeks to fill statutory gaps by creating a framework for a self-financed private university that focuses on integrated and holistic skill education pathways, distinct from conventional degree programs. The university is mandated to offer flexible learning systems and to frame a credit framework for competency-based skill and vocational education. It is also empowered to create centers of excellence for research and development relevant to the State's needs and to foster industry-academia partnerships. The Act ensures broad accessibility, stating that the university shall be open to all persons irrespective of class, caste, creed, religion, region, language, or gender, while also making special provisions for bonafide residents of Sikkim, reserving at least 25 percent of seats in each academic program, and implementing reservations for Scheduled Castes, Scheduled Tribes, Other Backward Classes, and Persons with Disabilities as per State Government policy. Furthermore, it mandates that the university seek accreditation from relevant national and international bodies like the University Grants Commission (UGC) and the National Council for Teacher Education (NCTE) before commencing any course. The Act establishes a robust governance structure, including a Governing Body as the supreme authority, and details financial mechanisms such as an Endowment Fund of two crore rupees, pledged to the Government as security, and a General Fund. Enforcement mechanisms are clearly defined, granting the State Government powers to inspect the university, issue directions, and even proceed with de-recognition or liquidation if the university fails to comply with the Act's provisions or faces financial mismanagement, ensuring accountability and adherence to academic standards. The Act also specifies timelines for fee structure approval, declaration of examination results, and the acquisition of land and construction of infrastructure as outlined in Schedule A.
