Sikkim Establishes Dedicated Calibration Station for Commercial Tank Lorries

The Government of Sikkim's Food and Civil Supplies Department, Legal Metrology Unit and Consumer Protection Cell, issued Notification No. 143/LMU/FCSD on August 18, 2025, which was subsequently published in the Sikkim Government Gazette on Thursday, August 21, 2025. This notification formally established a Tank Lorry Calibration Station at the Singtam Food Godown Complex in Gangtok District. The issuance of this instrument was necessitated by the existing legal framework, specifically sub-section (1) of section 24 of the Legal Metrology Act, 2009, which mandates the verification of any weight or measure used in transactions or for protection, and clause (c) of sub-rule (2) of the Legal Metrology (General) Rules, 2011, which requires periodical re-verification of weights or measures, including tank lorries, every twelve months. The notification came into force upon its publication in the Official Gazette.

Under the provisions of this new notification, all commercial tank lorries operating within the State of Sikkim for the transportation of petroleum products and other liquids are now required to apply for calibration at the newly designated station. Upon successful calibration, each tank lorry will be issued a Verification Certificate, which must be carried in the vehicle at all times and presented to any authorized official upon demand. This certificate will maintain validity for a period of twelve months, after which it will be subject to periodical renewal. The prescribed calibration fees are to be levied as per rule 17 read with Schedule IX of the Sikkim Legal Metrology (Enforcement) Rules, 2011. Non-compliance with the directives outlined in this notification will attract penalties as stipulated under the Legal Metrology Act, 2009, and the rules framed thereunder. The legislation provided: “All commercial tank lorries operating within the State for transportation of petroleum products and other liquids shall apply for calibration at the aforesaid newly established Tank Lorry Calibration Station.”

The legislative intent behind this notification is to reinforce the accuracy and integrity of measurements in commercial transactions involving liquid commodities transported by tank lorries across Sikkim. Prior to this, while the Legal Metrology Act, 2009, and its associated rules mandated the verification and re-verification of weights and measures, a dedicated and centralized facility specifically for tank lorries was not explicitly notified. This created a potential gap in ensuring consistent and efficient compliance for this particular category of commercial vehicles. By establishing a specific calibration station, the State Government aims to streamline the process of mandatory re-verification, thereby safeguarding consumer interests and promoting fair trade practices within the state. The measure addresses the practical challenge of ensuring that large-volume liquid transporters adhere to metrological standards, which are crucial for preventing discrepancies in quantity and ensuring transparency in the supply chain. The notification thus serves to operationalize and strengthen the enforcement mechanisms already present in the Legal Metrology Act, 2009, and the Legal Metrology (General) Rules, 2011, by providing a clear, accessible, and mandatory point of compliance for all relevant commercial operators.
