Sikkim Government Amends Service Rules to Define 'Teacher' Exclusions

The Sikkim Government Service (Amendment) Rules, 2008, were issued as a notification by the Department of Personnel, Administrative Reforms, Training, Public Grievances, Career Options & Employment Skill Development and Chief Minister's Self Employment Scheme. These rules, made in exercise of powers conferred by the proviso to Article 309 of the Constitution of India (which empowers the Governor to make rules regulating the recruitment and conditions of service of persons appointed to public services and posts in connection with the affairs of the State), further amended the Sikkim Government Service Rules, 1974. The legislation provided: “Explanation:- The word teacher does not include Principal of Senior Secondary Schools, Headmasters/ Headmistresses of Secondary Schools and faculty members of District Institute of Education and Training / State Institute of Education namely Principal, Senior Lecturers, Lecturers and Coordinators.” This clarification ensures that individuals holding positions such as Principals of Senior Secondary Schools, Headmasters or Headmistresses of Secondary Schools, and various faculty members including Principals, Senior Lecturers, Lecturers, and Coordinators at District Institute of Education and Training (DIET) or State Institute of Education (SIE) are not classified as "teachers" under the specific context of rule 98 of the 1974 Rules. This distinction is crucial for administrative clarity and the proper application of service conditions relevant to different categories of government employees in the education sector. The retrospective application of these rules suggests an intent to regularize or clarify the status of these positions from an earlier date.
