Sikkim Government Designates Licensing Authority for Drugs and Cosmetics Rules

The Government of Sikkim issued a Notification, bearing No. 18 / HC-HS FW., dated July 28, 2008, which formally appointed a Licensing Authority for the state. This Notification, published in the Sikkim Government Gazette Extraordinary on Wednesday, July 30, 2008, came into force upon its publication. The instrument was issued by the Department of Health Care, Human Services and Family Welfare, Drugs and Cosmetics Cell, Gangtok, exercising powers conferred by sub-rule (1) of rule 59 of the Drugs and Cosmetics Rules, 1945. The primary purpose of this notification was to establish a clear and designated authority responsible for licensing within the regulatory framework governing drugs and cosmetics.

The key provision of the notification stipulated the appointment of Shri C.N. Sharma, who held the position of Chief Drug Inspector within the Department of Health Care, Human Services and Family Welfare, as the Licencing Authority. This appointment was made specifically for the purpose of Part VI of the Drugs and Cosmetics Rules, 1945, and extended its jurisdiction across the entirety of Sikkim. This measure directly impacts individuals and entities involved in the manufacture, sale, and distribution of drugs and cosmetics within the state, as they would now interact with this designated authority for licensing matters. The legislation provided: “...the State Government hereby appoints Shri C.N. Sharma, Chief Drug Inspector of Health Care, Human Services and Family Welfare as the Licencing Authority for the purpose of part VI of the said rules for the whole of Sikkim.”

The legislative intent behind this notification was to strengthen the regulatory oversight and enforcement mechanisms for drugs and cosmetics in Sikkim. The Drugs and Cosmetics Rules, 1945, are a comprehensive central legislation that governs various aspects of these products, including their quality, safety, and efficacy. Rule 59(1) of these rules empowers state governments to appoint a licensing authority, thereby ensuring that there is a specific, accountable official to manage the issuance and regulation of licenses. Prior to such an appointment, the effective implementation of Part VI (which typically deals with the sale of drugs) would face practical challenges due to the absence of a clearly defined authority. This notification addressed that statutory gap by formally designating an individual to fulfill this critical role, thereby streamlining the licensing process and enhancing compliance. The appointment of a Chief Drug Inspector to this position also underscored the policy rationale of leveraging existing expertise within the health department for effective regulatory administration. This action did not introduce new rights or obligations but rather operationalized an existing statutory requirement, thereby facilitating the enforcement of the Drugs and Cosmetics Rules, 1945, across Sikkim.
