Sikkim Repeals Non-Biodegradable Garbage Control Act

The Government of Sikkim, through its Law and Parliamentary Affairs Department, issued a notification on June 22, 2023, announcing the enactment of The Sikkim Non-Biodegradable Garbage (Control) (Repealing) Act, 2023. This legislation, designated as Act No. 06 of 2023, received the assent of the Governor on June 8, 2023, and was published for general information, coming into force immediately upon its publication. The primary purpose of this Act is to repeal the Sikkim Non-Biodegradable Garbage (Control) Act, 1997, thereby streamlining the legal framework governing waste management within the state.

The repeal was necessitated by the enforcement of comprehensive central regulations concerning waste management. The legislation provided: “WHEREAS, with the enforcement of the Solid Waste Management Rules, 2016 and the Plastic Waste Management Rules, 2016 to the state of Sikkim, it is necessary to repeal the Sikkim Non-Biodegradable Garbage (Control) Act, 1997.” Specifically, the Solid Waste Management Rules, 2016, notified by the Central Government on April 8, 2016, and the Plastic Waste Management Rules, 2016, notified on March 18, 2016, both framed under the Environment (Protection) Act, 1986, had been extended and enforced across Sikkim. With these detailed and overarching rules in place, the state's earlier legislation on non-biodegradable garbage control became redundant. The new Act explicitly repealed the 1997 Act, ensuring that the state's legal provisions for waste management are aligned with the updated national standards.

Despite the repeal, the new Act includes a crucial savings clause to prevent any disruption to past actions or ongoing legal matters. This clause stipulates that the repeal shall not affect the previous operation of the 1997 Act, or anything duly done or suffered under it. Furthermore, it preserves any right, privilege, obligation, or liability acquired, accrued, or incurred under the repealed Act. Any penalties, forfeitures, or punishments incurred, or any investigations, legal proceedings, or remedies initiated under the 1997 Act, remain unaffected and may be instituted, maintained, or enforced as if the repealing Act had not been passed. This provision ensures legal continuity and protects vested interests or liabilities that arose during the period the 1997 Act was in force, preventing a legal vacuum or retrospective invalidation of past actions. The legislative intent behind this repeal was to eliminate overlapping and potentially conflicting state-level legislation, thereby fostering a unified and more effective regulatory environment for solid and plastic waste management in Sikkim under the ambit of the Central Government's rules.
