Sikkim University Act, 2006 Establishes New Central University in the State

The Parliament enacted The Sikkim University Act, 2006, designated as Act No. 10 of 2007, to establish and incorporate a teaching and affiliating university within the State of Sikkim. This legislative instrument, which received presidential assent on January 10, 2007, came into force on July 2, 2007, following a notification by the Central Government. The Act created the Sikkim University as a body corporate with perpetual succession and a common seal, headquartered in Gangtok. It outlined a comprehensive framework for the university's governance, academic functions, and administrative operations, affecting educational institutions, students, teachers, and employees across Sikkim. Key provisions included the establishment of various authorities such as the Court, the Executive Council, the Academic Council, the College Development Council, the Board of Studies, and the Finance Committee, each with defined powers and functions. The Act also detailed the roles of key officers, including the Chancellor, Vice-Chancellor, Registrar, and Finance Officer, and stipulated conditions for their appointment and service. Furthermore, it provided for the admission of colleges and institutions to the university's privileges, the conduct of examinations, and mechanisms for dispute resolution concerning employees and students.

The legislative intent behind the Act was to disseminate and advance knowledge by providing instructional and research facilities across diverse branches of learning. The legislation aimed to make provisions for integrated courses in humanities, natural and physical sciences, social sciences, forestry, and other allied disciplines. A core objective was to promote innovations in the teaching-learning process, inter-disciplinary studies, and research. The Act specifically sought to educate and train manpower for the development of the State of Sikkim and to pay special attention to the improvement of the social and economic conditions and welfare of the people of that State, fostering their intellectual, academic, and cultural development. The legislation provided: “The objects of the University shall be to disseminate and advance knowledge by providing instructional and research facilities in such branches of learning as it may deem fit; to make provisions for integrated courses in humanities, natural and physical sciences, social sciences, forestry and other allied disciplines in the educational programmes of the University; to take appropriate measures for promoting innovations in teaching-learning process, inter-disciplinary studies and research; to educate and train manpower for the development of the State of Sikkim; and to pay special attention to the improvement of the social and economic conditions and welfare of the people of that State, their intellectual, academic and cultural development.” This establishment addressed the need for a central university to cater to the specific educational and developmental requirements of Sikkim. The Act ensured that the university would be open to all persons irrespective of caste, creed, race, or class, while also allowing for special provisions for women, persons with disabilities, and weaker sections of society, including Scheduled Castes and Scheduled Tribes. It established the President of India as the Visitor of the University, granting powers of review, inspection, and inquiry to ensure compliance with the Act and proper administration. The Governor of Sikkim was designated as the Chief Rector. The Act also introduced new obligations for educational institutions within Sikkim, mandating their association with the new university and deeming any prior affiliations with other Indian universities withdrawn upon the Act's commencement, subject to Central Government exemptions. Enforcement mechanisms included a structured appeals process for employees and students, and provisions for the Central Government to remove difficulties in implementing the Act and to ensure parliamentary oversight of Statutes, Ordinances, and Regulations.
