Tobacco Board Rules Amended to Introduce Three-Year Validity for Registrations and Licenses

The Central Government, through a notification issued by the Ministry of Commerce and Industry (Department of Commerce) on April 22, 2025, introduced the Tobacco Board (Amendment) Rules, 2025. These rules, which came into force on the date of their publication in the Official Gazette, amend the existing Tobacco Board Rules, 1976. The amendments were made in exercise of the powers conferred by section 32 of the Tobacco Board Act, 1975, a legislative provision that grants the Central Government authority to make rules for carrying out the purposes of the Act. The primary objective of these amendments is to streamline the regulatory process for tobacco growers and barn operators by extending the validity period of registration certificates and licenses from one year to a block period of three years.

Under the revised framework, several key provisions of the principal rules have been altered. Specifically, sub-rules (5), (6), and (7) of rule 33, which pertain to the validity of registration certificates, were substituted. The new rules stipulate that every certificate of registration granted under section 10 of the Act shall now be valid for a block period of three years, as specified in the certificate. Consequently, the renewal of such certificates will also be for a block period of three years, endorsed directly on the certificate. This change ensures that both initial registrations and subsequent renewals align with the new three-year block period. Similarly, rule 34N, which governs licenses for the operation of tobacco barns, saw its sub-rules (2) and (3) substituted. A license for barn operation must now be renewed for every block period of three years, ceasing to be effective upon the expiry of this period if not renewed. Applications for such renewals are to follow the same procedure as fresh applications, and a fee of rupees ten per year for every barn remains applicable. The legislation provided: “Every certificate of registration granted under section 10 shall be in Form 2 and shall be valid for a block period of three years specified in such certificate.”

Further consequential amendments were made to various forms prescribed under the rules to reflect this change in validity. In Form 1, which is used for registration applications, item 7 was substituted to require the "Block period for which registration is sought," and item 10 was updated to include a "Crop wise plan for utilisation of the total area available with the applicant during the block period of three years." Form 2, the certificate of registration, now states "Valid for ________ block period" instead of "Valid for one year." Correspondingly, Form 25, used for barn license applications, now requires applicants to specify the "block period for which registration has been sought" if they are registered growers. Lastly, Form 26, the barn license itself, also reflects the new "Valid for ________ block period" designation. These changes aim to reduce the administrative burden on both the regulated entities and the Tobacco Board by decreasing the frequency of renewals and associated paperwork, thereby enhancing the efficiency of the regulatory process for tobacco cultivation and processing. The earlier legal position mandated annual renewals for both registration certificates and barn operation licenses, which the new rules address by introducing a longer, more convenient validity period.
