Uttar Pradesh Judicial Service Examination Syllabus to Incorporate Substituted Enactments

The Governor of Uttar Pradesh, acting in pursuance of Article 348(3) of the Constitution, ordered the publication of The Uttar Pradesh Judicial Service (Sixth Amendment) Rules, 2025, on July 25, 2025. These rules, issued under the powers conferred by Article 234 and the proviso to Article 309 of the Constitution, were formulated in consultation with the Uttar Pradesh Public Service Commission and the High Court of Judicature at Allahabad. The primary objective of this legislative instrument was to amend the existing Uttar Pradesh Judicial Service Rules, 2001. Specifically, the amendment focused on updating the syllabus for the competitive examination for recruitment to the Uttar Pradesh Judicial Service. The new rules, officially titled The Uttar Pradesh Judicial Service (Sixth Amendment) Rules, 2025, came into force immediately upon their publication. The key change introduced by these rules involves the substitution of the existing Appendix-II of the 2001 Rules, which outlines the syllabus for the competitive examination.
The legislative intent behind The Uttar Pradesh Judicial Service (Sixth Amendment) Rules, 2025, was to ensure that the competitive examination for judicial service recruitment remains current and reflective of the prevailing legal framework. The earlier legal position, as per the Uttar Pradesh Judicial Service Rules, 2001, specified a syllabus for the examination. However, with the dynamic nature of legislation, enactments forming part of the syllabus could be repealed or substituted over time, potentially leading to a disconnect between the examination content and the current laws. This amendment addresses that statutory gap by explicitly clarifying the scope of the syllabus. The legislation provided: “The examination shall include the following subjects and any enactment forming part of the syllabus shall include its substituted enactment.” This provision ensures that candidates preparing for the judicial service examination will automatically be required to study the most up-to-date versions of laws, even if an original enactment mentioned in the syllabus has been replaced by a new one. This measure aims to maintain the relevance and efficacy of the recruitment process, ensuring that successful candidates possess knowledge of the current legal landscape. The amendment primarily affects aspiring judicial officers in Uttar Pradesh, the Uttar Pradesh Public Service Commission responsible for conducting the examination, and the High Court, which plays a consultative role in the rules' formulation.
