Uttar Pradesh Modifies Eligibility for Education Service Selection Commission Posts

The Governor of Uttar Pradesh recently promulgated The Uttar Pradesh Education Service Selection Commission (Amendment) Ordinance, 2025, designated as U.P. Ordinance No. 15 of 2025. This legislative instrument was issued on November 18, 2025, in pursuance of clause (1) of Article 213 of the Constitution of India, which empowers the Governor to promulgate such temporary laws when the State Legislature is not in session and immediate action is deemed necessary. The Ordinance primarily aims to amend the Uttar Pradesh Education Service Selection Commission Act, 2023. A significant change introduced by this Ordinance is the substitution of clause (a) in sub-section (2) of Section 4 of the principal Act. This amendment revises the eligibility criteria for a specific post within the Commission, now requiring that the individual "is holding or has held the post of Principal Secretary to the State Government or a post equivalent thereto." The Ordinance came into force immediately upon its publication in the official Gazette.

The promulgation of this Ordinance reflects a legislative intent to streamline or enhance the administrative capacity of the Uttar Pradesh Education Service Selection Commission. By modifying the eligibility requirements for a key position, the State Government appears to be addressing a perceived need for experienced administrative leadership within the Commission. The earlier legal position, established by the Uttar Pradesh Education Service Selection Commission Act, 2023, is thus updated to allow for a broader or more specific pool of candidates with high-level governmental experience. The legislation provided: “…for clause (a), the following clause shall be substituted, namely:-(a) is holding or has held the post of Principal Secretary to the State Government or a post equivalent thereto; or” This substitution directly addresses any statutory gaps or limitations in the previous eligibility framework, ensuring that individuals with significant administrative experience at the Principal Secretary level or its equivalent are eligible for appointment. Furthermore, the Ordinance includes a "Power to remove difficulties" clause under Section 3, allowing the State Government to issue orders for adaptations, modifications, additions, or omissions to the principal Act for a period of two years from the Ordinance's commencement, to facilitate its smooth implementation. Any such order must be published in the Gazette. Section 3(2) stipulates that every order made under sub-section (1) shall be laid before both Houses of the State Legislature as soon as may be after it is holding or has held the post of Principal Secretary to the State Government or a post equivalent thereto. This mechanism underscores the policy rationale of ensuring effective functioning of the Commission while maintaining legislative accountability.
